Terms of Service

Welcome to Moment, a product of ProAttitudes, LLC ("Company," "we," "us," or "our"). By accessing or using our application at app.yourmoment.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Description of Service

Moment is a mindful reflection and decision-support application designed to help users pause, identify emotional patterns, and make conscious choices. The Service uses AI-assisted guidance and structured reflection prompts. It is not a substitute for professional mental health therapy, medical advice, or crisis intervention.

2. Eligibility

You must be at least 18 years of age to use the Service. By using Moment, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.

3. Account Registration

You may be required to create an account to access certain features. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@proattitudes.com if you suspect unauthorized access.

4. Subscriptions and Payments

Moment offers free and paid subscription tiers. Paid plans are billed through Stripe, a third-party payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis (monthly or annually, as selected).

All payments are in USD and are non-refundable except where required by law.
You may cancel your subscription at any time through your account settings or by contacting us. Access continues through the end of the current billing period.
We reserve the right to change pricing with 30 days' notice.
Complementary access granted by the Company may be revoked at any time.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any regulations.
Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Scrape, reverse-engineer, or replicate any portion of the Service without written permission.
Submit content that is harmful, abusive, or violates the rights of others.
Use the Service as a substitute for emergency mental health services. If you are in crisis, please contact the 988 Suicide and Crisis Lifeline by calling or texting 988.

6. AI-Generated Content

Moment uses artificial intelligence to provide reflection prompts and coaching responses. AI-generated content is for informational and self-development purposes only. It does not constitute professional advice (medical, psychological, legal, or financial). The Company does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

7. User Content

By submitting content through the Service (including reflection notes, journal entries, and responses), you grant ProAttitudes, LLC a non-exclusive, royalty-free license to use that content solely to operate and improve the Service. We will not sell your personal reflections to third parties. See our Privacy Policy for full details.

8. Intellectual Property

All content, design, code, and branding within the Service — including but not limited to the Moment name, logo, and user interface — are the exclusive property of ProAttitudes, LLC or its licensors. Nothing in these Terms grants you any right to use our intellectual property without prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

10. Third-Party Integrations

The Service integrates with third-party services including Stripe (payments) and GoHighLevel (CRM). Your use of those services is subject to their respective terms and privacy policies. ProAttitudes, LLC is not responsible for the practices of third-party providers.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROATTITUDES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless ProAttitudes, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms within the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law
